24 - General Information

This TOS constitutes the entire agreement between the User and HomeComm and governs the User's use of the Service, superseding any prior agreements between the User and HomeComm. The User also may be subject to additional terms and conditions that may apply when the User uses affiliate Service, new Service, third-party content or third-party software.

The TOS and the relationship between the User and HomeComm shall be governed by the laws of Malaysia without regard to its conflict of law provisions. The failure of HomeComm to exercise or enforce any right or provision of the TOS shall not constitute a waiver of such right or provision.

The User agrees that no joint venture, partnership, employment, or agency relationship exists between the User and HomeComm as a result of this agreement or use of the Service.

If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed to be superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect. In addition, the section titles in the TOS are for convenience only and have no legal or contractual effect.

The User agrees that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

HomeComm's performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of HomeComm's right to comply with governmental, court and law enforcement requests or requirements relating to the User's use of the Service or information provided to or gathered by HomeComm with respect to such use.

A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
